Maternal Mobbing, also with in vitro fertilization

We know that unfortunately there are still many cases of layoffs in pregnant women or in those who plan to be.

The last that has been known is that of an Austrian woman who was undergoing an in vitro fertilization process, who she was fired two days after communicating that the embryos were going to be implanted.

European law prohibits firing a working woman from the time she becomes pregnant until the maternity leave ends because she is obviously discriminatory. But what happens in the case of women who are under artificial fertilization treatments?

According to the general lawyer of the EU Court of Justice, this is not the case because “technically” the woman was not yet pregnant for legal purposes.

From my point of view it is a clear case of maternal mobbing. Although the implanted embryos were not yet there, she said that in a few days she would be pregnant, something that women who become pregnant by the natural method cannot know. For me, in this case, being pregnant or communicating that in a few days it will be is exactly the same.

The question is, from when is it considered that a woman who undergoes an in vitro fertilization is pregnant, since the embryos are transferred to the uterus or since the eggs are fertilized and become embryos?

A common criterion should be established to prevent such situations from recurring. We will see what happens in this case, maybe it serves as a precedent.
